You as our distributor (”Publisher”) certify that you will use our services and market our products and services (including, without limitation, text messages and commercial emails) only to customers and prospects that have expressly consented (opted-in) to receive them.

Our Publishers are forbidden to transmit unsolicited text messages or commercial email (spam) via our system or spam to promote our products and services. BE does not buy or sell email or phone number lists, nor do we allow our Publishers to use purchased or harvested email or phone number lists. All our Publishers are mandatorily required to be in compliance with our Anti-Spam Policy;

  1. What is Spam? Spam, also known as junk mail, is unsolicited commercial email messages, especially (but not only) bulk email messages. “Unsolicited” means that the recipient has not provided verifiable permission to send the message. “Bulk” means that the message is sent as part of a larger collection of messages, all having substantively identical content. The term “spamming” refers to transmitting, distributing or delivering any unsolicited commercial e-mail correspondence, especially in mass quantities, through electronic means of communication.

  2. Don’t use misleading header information: “Header information” refers to the extra information sent along with your email campaign, such as the “from” name, subject line, and reply-to Email marketing laws stipulate that you must not include incorrect or misleading information in these fields to try to trick people into opening your email campaigns. The key is not to purposely deceive your recipients. Arousing curiosity or getting creative with your subject line is perfectly acceptable, as long as you don’t purposely try to deceive recipients.

  3. Identify your email as an advertisement: The laws stipulate that you must clearly and conspicuously disclose that your message is an advertisement. The law gives a lot of leeway in how you do this, and you don’t need to specifically state “This email is an advertisement” every time you send a campaign. It’s more about not purposely deceiving your recipients into thinking this is a personal email.

  4. Include your address: Most countries’ email marketing laws stipulate that you must clearly include a valid postal address for your business in your email campaigns. This can be your current street address, a postbox address, or an address with a registered commercial mail-receiving company.

  5. Include a way to opt-out of receiving future emails from you: Most countries’ email marketing laws stipulate that your email campaigns include a clear and conspicuous mechanism for opting out of receiving emails from you in the future and that this mechanism is easy for an ordinary person to recognize and understand.

  6. Honour opt-out requests promptly: The laws stipulate that you must honour a recipient’s opt-out request within reasonable days and that you cannot charge a fee to opt them out, require the recipient to give you any personally identifying information beyond an email address or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website to opt-out.

  7. If you Spam, what happens? If we find out that you're spamming using our platform, brand or company name or while promoting our products or services then you can expect all or some of the following to occur;

    1. Without a doubt, we will shut down your account immediately, and we will not refund your account and pending commissions notwithstanding anything contrary provided in our Refund and Cancellation or any other documents or agreement.
    2. We might also ask you to compensate us if your spamming activity causes any interruptions in our ability to service our other customers and Publishers. We may also take legal action against you.

We strongly advise you to NOT SPAM customers or prospective Publishers. We also advise you to follow the tips and advice issued by the local regulatory authorities.
